Canada Work Permit Pathways

Canada can be the land of opportunity if you want to work. Every year thousands of workers provide their skills and efforts to the Canadian labour market. Foreign workers play a very crucial role. You can be issued a work permit if you meet the following criteria:

  • you must secure a job offer from an employer in Canada
  • your employer has received a labour marker impact assessment (“LMIA”)
  • you have the skills or knowledge to perform the job
  • you are admissible in Canada
  • you can financially support yourself in Canada
  • you will leave Canada at the conclusion of the period authorized for your stay

Open Work Permits

There are many different streams of work permits, but generally work permits fall into two types of categories; work permits are either open or closed. The main differences between the two are that an open work permit does not require an employer to have a LMIA and you can work for any employer. Whereas the closed work permit requires an employer to have a LMIA and you are generally restricted to only the employer stated on the work permit.

Open work permits also do not require you to have a prerequisite job offer, and it does not restrict you to a specific geographical location, industry, or occupation. There are multiple streams for open work permits and each stream has its own unique criteria.

Spousal Work Permi

If you are the spouse of a person that is studying in Canada or is working in job that is classified under TEER 0-4, or if you are applying for permanent residence under the in-Canada spousal sponsorship, you may be entitled to an open work permit.

Spousal work permits will allow you to work in Canada for any employer without first obtaining a job offer as you accompany your spouse while they are legally residing in Canada.

Post-Graduate Work Permit

One of the most popular open work permits in Canada is the postgraduate work permit. To qualify for a postgraduate work permit, you must meet the following criteria:

  • you have graduated from a publicly-funded, designated learning institution
  • you have completed a study program on a full-time basis that was at least 8 months or longer in duration
  • you applied within 180 days of completing your studies
  • you are admissible in Canada

A postgraduate work permit is only issued once in your lifetime and it will be issued for a maximum duration of 3 years if you have completed an eligible program of 2 years or more.
